1. Acceptance of Terms

By accessing or using the Tokpulse service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Tokpulse provides real-time tracking and analytics for AI/LLM API usage and costs. The Service collects token counts and metadata from your API calls to supported providers (OpenAI, Anthropic, Google AI, xAI) and presents usage dashboards and cost breakdowns.

Tokpulse does not store, process, or have access to the content of your prompts or completions. Only token counts and request metadata are transmitted to our servers.

3. User Accounts

To use the Service, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. API Keys & Usage

The Service provides you with API keys to authenticate requests. You are responsible for keeping your API keys secure. Do not share your API keys publicly or embed them in client-side code. You are responsible for all usage incurred through your API keys.

We reserve the right to impose rate limits or usage quotas to ensure fair access for all users. Current free-tier limits are documented on our website and may change with reasonable notice.

5. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malware, viruses, or other harmful code
• Resell or redistribute the Service without written permission

6. Limitation of Liability

To the maximum extent permitted by applicable law, Tokpulse GmbH and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the dashboard settings.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
